What Is a Power of Attorney? 

A power of attorney (POA) is a legal document that allows you (“principal”) to appoint someone you trust (“agent”) to make decisions on your behalf if you’re unable to do so yourself. Depending on the POA, your agent may have authority to sign documents, pay bills, handle real estate transactions, or make other important decisions. 

A power of attorney can take effect immediately or only after a specific event, such as incapacity. Choosing the right type of POA is a crucial part of a comprehensive estate plan. Types of Powers of Attorney in California

General POA

A general power of attorney grants the broadest range of authority for many financial and legal matters, such as handling bank accounts, signing tax returns, or buying and selling real estate. However, it doesn’t include medical decisions. 

Springing POA

A springing power of attorney remains inactive until an event occurs, such as a future calendar date, asset transaction, or the principal becoming incapacitated or reaching a certain age. This POA can be general or limited to specific tasks. 

Limited (Special) POA

A limited or special power of attorney handles a single event or financial or legal transaction for a brief time. This POA is narrow in scope and restricted to a defined task, such as closing a home sale or signing a contract while the principal is traveling abroad.

Advance Health Care Directive

An advance health care directive (AHCD) is a durable POA for medical and end-of-life choices. It combines a medical POA with a living will, allowing an agent to make healthcare decisions only when the principal is incapacitated or unable to communicate.  

What Makes a Power of Attorney Legally Enforceable?

Powers of attorney must meet various legal requirements to be legally valid, including:

• Mental capacity. The principal must be an adult of sound mind when the power of attorney is executed.
• Voluntary and in writing. The POA must be in writing, be enacted voluntarily without coercion, and clearly identify the principal, agent, and authority.
• Signed and dated. The document must include the date of its execution and be signed by the principal or on the principal’s behalf if they are unable to do so. 
• Witnesses. The document must be signed by at least two witnesses who are adults. If there aren’t two witnesses, the POA can be signed by a notary public.

What Makes a POA “Durable”?

A power of attorney is non-durable by default unless it contains statutory language making it durable. The primary difference between a durable POA and a non-durable POA is what happens to the agent’s authority if you become incapacitated. A non-durable POA terminates automatically the moment you lose capacity, while a durable POA remains effective through your incapacity.

Do I Have to Notarize a Power of Attorney? 

To create a POA, you must either have it signed by two qualified witnesses or acknowledged by a notary public. The appointed agent can’t act as a witness. Witnesses must be at least 18 years old and must physically witness the principal signing or acknowledging the document (Cal. Probate Code § 4122). 

If the POA is an advance health care directive, medical POA, or healthcare proxy, the witnesses cannot be related to the principal by blood, marriage, or adoption. When Does a Power of Attorney End? 

Under Cal. Probate Code § 4152, an agent’s authority ceases when the principal passes away. Other grounds for termination include: 

• Expiration of terms. The document specifies dates or conditional triggers that end the agreement.
• Fulfillment of purpose. The legal or financial objective is completed or the underlying property ceases to exist.
• Principal revocation. The principal executes a formal revocation that strips the agent of their authority.
• Agent incapacity or unavailability. The agent resigns, is legally removed, becomes incapacitated, or passes away.
• Marital dissolution. The legal relationship ends if the agent is the principal’s spouse and the marriage is dissolved or annulled.
